How to Avoid Costly Dilapidations?

To limit your liability under a lease and breaches of a covenant, a Schedule of Condition can be helpful. Keep safe records of everything from lease negotiations to executed documents, and maintain the property well to reduce end-of-lease liabilities. If altering or fitting out the property, follow lease procedures and seek permission from the landlord.

When receiving a Schedule of Dilapidations, we recommend that tenants to undertake & seek advice from an experienced surveyor to assess your property and prepare a response to the landlord’s claim. Negotiate the claim with your surveyor’s technical arguments and tactics. If an agreement cannot be reached, consider dispute resolution options. A Schedule of Dilapidations will outline the work required to return the property to its original state, with the cost often being significant. Dilapidated refers to a building or sometimes an object that is in a state of disrepair or ruin as a result of age or neglect. When discussing properties, it often refers to commercial properties that have been damaged and left in poor conditions when a tenant vacates. To remedy the dilapidation, APT are often called in to clean and repair commercial facilities, ensuring that they are put back into their pre-tenanted state, ensuring the property is returned to the landlord in its previous state. Our service is always in compliance with your contractual agreement and we do our very best to ensure you won’t be caught out by end of tenancy fees!
The cost of industrial cleaning is entirely dependable on the task at hand. At APT, we have been providing industrial cleaning services to businesses across the UK for over 30 years. When we first communicate with clients regarding a industrial cleaning job, we often use photographs to understand the initial requirements of the job. After communication has begun, we will send one of our specialist technicians to provide a detailed, free, non-obligation quotation. The quotation will provide a detailed analysis of how the job will be carried out, the industrial cleaning processes that we will follow and the anticipated result. Dilapidations in property refer to breaches of leases due to the condition of the property being leased. This can occur during the lease or at the end of the tenancy period. Wear and tear, mistreatment and neglect to the property can mean that the tenant is required to have the property put back to its original state, or for the landlord to arrange for the repairs and can legally claim for the payment of these by the tenant. Further work is sometimes required at the end of the lease to reinstate any alterations that have been made to the property. 

Our 30 years of dealing with dilapidations of properties means that we have the knowledge and expertise to ensure you are only doing what is required in your contractual documentation. The works we carry out to reinstate the property are in-line with your contractual obligations and we work closely with your legal team to advise on the best methods to ensure you do not receive a huge bill at the end of your tenancy. 

Sometimes there are disputes about who is responsible for the repairs so it is always advisable for both the landlord and the tenant to seek the advice of a professional when drawing up the schedule of works. To determine whether a repair needs to be done, we need to consider four questions:
  1. 1. Does the lease cover the item needing repair?
  2. 2. Is the item in a bad condition compared to when the building was first constructed?
  3. 3. What work needs to be done to fix the item to an acceptable standard?
  4. 4. Was it reasonable to expect the type of work that was done?
Tenants may think that if the property is in better condition now than when they first leased it, they shouldn’t have to do repairs. However, the obligation to keep the property in good repair is not just a comparison between the beginning and end of the lease. It includes an implicit requirement to first bring the property to a good state and then maintain it.

A landlord can claim for dilapidations during the tenancy if they are aware of mistreatment of the property. However, in most cases the landlord is expected to serve a schedule of dilapidations within a reasonable time on the tenant, not more than 56 days after the end of the tenancy. The landlord and tenant will then be required to enter into negotiations to establish how the repairs will be carried out and ensure that a sufficient conclusion will be reached.

The required standard of repair is determined by the state of the property when the lease was granted and we always do our best to ensure the property is put back to its original state. 

When purchasing a leasehold property, it’s often legally required that you speak with the landlord prior to making any alterations and seek their permission to carry out any alteration works.

At the end of the tenancy, a dilapidations survey will be carried out by an accredited surveyor to ensure that the property has been returned to its original state. The survey is highly detailed and reports on the current condition of the property, looking at the physical structure and systems to issues involving furnishing and general wear and tear. 

We work closely with accredited surveyors when conducting dilaps surveys and understand the required amendments and repairs required to put the property back to its original state. This helps to ensure you’re not lumped with a huge bill at the end of your tenancy and equally ensures that your landlord is not faced with a property they’re unable to lease back out once you’ve left. 

The value of the property is calculated through established the value of the covenanted state of the property, minus the costs of the repair.
